1. IDENTIFICATION OF THE PROVIDER
SKYLEX TECH ACADEMY S.A.S. - TERMS AND CONDITIONS OF MEMBERSHIP, EDUCATIONAL ACCESS AND ACQUISITION OF SKYACADEMY SERVICES
These Terms and Conditions govern the acquisition and use of memberships and educational services offered by SKYLEX TECH ACADEMY S.A.S., a company identified by NIT 902.073.916-6, domiciled in Medellín, Antioquia, at Calle 10 No. 42-45 Oficina 314, Edificio Plaza Poblado, email founder@xskylex.com and telephone numbers +57 324 252 7900 / +57 322 417 3435, hereinafter SKYLEX.
2. ACCEPTANCE OF THE AGREEMENT
The acquisition of any membership available at SKYACADEMY implies the express acceptance of these Terms and Conditions by the student, user or customer, hereinafter the “Student”.
Acceptance may take place through electronic means, including acceptance checkboxes, forms, payment platforms, data messages or other mechanisms that allow the Student's intention to be evidenced.
Acceptance of these Terms and Conditions constitutes the agreement applicable to the provision of the services acquired.
3. NATURE OF THE SERVICE
SKYACADEMY provides education, instruction, training, guidance and access to digital tools of an academic, technological and informational nature. Content related to sales, personal finance, marketing, dropshipping, personal branding, digital franchising, affiliate marketing or other areas does not constitute raising money from the public, financial intermediation, administration of third-party resources, professional investment management or a promise of returns.
SKYLEX does not receive money from the Student to invest it, administer it or generate returns on the Student's behalf.
The Student remains responsible at all times for their economic, commercial and business decisions.
4. AVAILABLE MEMBERSHIPS
SKYACADEMY offers the following options:

The total price, currency, applicable taxes or surcharges, included period and renewal conditions are disclosed in the offer before the purchase is confirmed and identified in the purchase confirmation. Price changes for future purchases do not change the amount or conditions of an Order already accepted. Payment is made through the enabled method selected by the Student.
5. MEMBERSHIP CONTENT
5.1. BASIC Membership Grants access to SKYACADEMY during the period included in enrollment and training in one (1) digital area, chosen by the Student, from:
• Dropshipping.
• Personal branding.
• Digital franchising and affiliate marketing.
• Sales and personal finance.
5.2. PLUS Membership Grants access during the period included in enrollment and training in two (2) digital areas, chosen by the Student from the available areas. Additionally includes:
• SkySystem: complete semi-automatic sales system.
5.3. PRO Membership 3 Grants access during the period included in enrollment and training in three (3) digital areas, chosen by the Student. Additionally includes:
• SkySystem: complete semi-automatic sales system.
• SkyTeacher IA: virtual tutor available for educational guidance.
5.4. VIP Membership Grants access during the period included in enrollment and training in four (4) digital areas, chosen by the Student.
Additionally includes:
• SkySystem: complete semi-automatic sales system.
• SkyTeacher IA: virtual tutor available for educational guidance.
• SkyBrand: artificial intelligence system oriented toward personal brand development.
• Personalized support team.
6. TRAINING AND METHODOLOGY
The training areas may comprise content corresponding to basic, intermediate and advanced levels, through prerecorded material and live classes.
Each course may include, according to the corresponding program:
• Prerecorded content.
• Live classes.
• Exercises and practice.
• Assessments.
• Supplementary academic material.
• Internal certification, when the established academic requirements are met.
Live classes may amount to approximately between four (4) and twelve (12) hours, depending on the course or area acquired.
4 Content, tools, methodologies, schedules and resources may be updated, replaced or improved without affecting the essential nature of the contracted service.
7. ACTIVATION AND DURATION OF ACCESS
Access to the membership will be activated once SKYLEX receives payment confirmation and the Student's registration process is completed.
The period included in each membership will begin to run from activation of access.
After the included period ends, the Student may continue using the services through the renewal they select, at the price, duration and conditions disclosed before confirming that new purchase, according to the membership option acquired.
Access will be maintained while the membership remains valid and payments are up to date.
8. RENEWAL AND CANCELLATION
Memberships that continue through monthly payments may be canceled by the Student to avoid future charges, through the channels enabled by SKYLEX.
Cancellation does not affect access corresponding to the period already paid, unless a legal or contractual ground determines otherwise.
SKYLEX may not make charges after a duly requested cancellation, except for previously accrued obligations or situations authorized by law.
9. COMMERCIAL REFUND POLICY
Without prejudice to consumer rights recognized by Colombian legislation, SKYLEX establishes a commercial money-back guarantee of seven (7) calendar days counted from acquisition of the membership.
Within that period, the Student may request a refund of the amount paid through SKYLEX's official support channels.
The request must identify the Student, the membership acquired, the acquisition date and the method used to make payment.
This commercial guarantee is without prejudice to the right of withdrawal, payment reversal, warranties and other rights that may apply under current legislation.
Where a statutory right to a refund or withdrawal exists, it will prevail over any commercial condition less favorable to the consumer.
Where an exception to the right of withdrawal legally applies because provision of the service has begun with the consumer's authorization, that circumstance will be taken into account in accordance with applicable legislation.
10. PAYMENT METHODS AND EVIDENCE OF ACQUISITION
Payment may be made through the electronic or financial methods enabled by SKYLEX or by the payment operators used for the transaction.
Once payment is confirmed, SKYLEX may generate and send the Student a confirmation, proof of payment, receipt, invoice or equivalent document, as legally appropriate, evidencing acquisition of the membership.
The confirmation must identify, at a minimum:
• Name of SKYLEX TECH ACADEMY S.A.S.
• NIT 902.073.916-6. • Identification of the Student.
• Membership acquired.
• Acquisition date.
• Amount paid.
• Included period.
• Payment method, where applicable.
• Activation date or commencement of the service.
11. INTELLECTUAL PROPERTY AND PERSONAL USE
The courses, videos, texts, methodologies, academic materials, platforms, tools, systems, software, content, trademarks, designs 6 and other elements supplied by SKYLEX are protected by applicable intellectual property rules.
Membership grants a personal, limited and non-transferable right of access and use, exclusively for the Student's educational purposes.
Copying, reproducing, commercializing, sublicensing, distributing, reselling, publishing, sharing credentials, extracting content on a mass scale or allowing access by unauthorized third parties is prohibited.
12. ACCOUNT AND CREDENTIALS
The Student must provide truthful information and keep their access credentials confidential.
The account is personal. SKYLEX may adopt security measures when it detects shared use, unauthorized access, fraud or use contrary to these Terms.
Where evidence of noncompliance exists, SKYLEX may temporarily suspend access while it verifies the situation, without prejudice to the Student's rights.
13. RESULTS AND THE STUDENT'S RESPONSIBILITY
SKYLEX provides education, tools, content and guidance. Acquiring a membership does not guarantee income, sales, profits, customers, employability, business growth or specific economic results.
Results will depend, among other factors, on application of knowledge, dedication, market conditions, individual ability and decisions made by the Student.
14. PERSONAL DATA
The Student's personal data will be processed in accordance with SKYLEX TECH ACADEMY S.A.S.'s Personal Data Processing and Protection Policy, available through SKYLEX's official channels.
Acceptance of these Terms does not replace authorization for personal data processing when such authorization is legally required.
15. SUPPORT AND ASSISTANCE
The Student may submit requests, petitions and complaints related to the membership or service acquired through SKYLEX's official channels:

16. MODIFICATION OF THE TERMS
SKYLEX may update these Terms and Conditions where necessary due to legal, regulatory, technological, operational or commercial changes. Modifications affecting essential conditions of a membership already acquired will not prejudice the Student's previously vested rights.
17. APPLICABLE LEGISLATION
These Terms and Conditions will be governed by the laws of the Republic of Colombia, including applicable rules on consumer protection, electronic commerce, contracting and personal data protection.
No provision of these Terms may under any circumstances be interpreted as a consumer's waiver of non-waivable rights.
EVIDENCE OF ACQUISITION AND ACCEPTANCE
Upon completion of the acquisition, the Student declares:
1. That they received sufficient, clear and understandable information about the selected membership, its price, duration, content and access conditions.
2. That they had access to these Terms and Conditions before completing the acquisition.
3. That they know SKYLEX provides educational, technological and informational services and does not raise, administer or receive money to invest on behalf of the Student or guarantee economic returns.
4. That the membership acquired corresponds to the option selected during the purchase process.
5. That they know the renewal, cancellation and refund conditions established in this document.
6. That they accept personal access to the content and tools corresponding to the membership acquired.
7. That they accept these Terms and Conditions through the electronic mechanism provided for contracting.
